Terms and Conditions of Service
The Customer acknowledges that:
the website margheritab.com is owned by MargheritaB. Srl, headquartered at PIAZZA DELLA VITTORIA 9, 25122 BRESCIA (BS) and having VAT number: 12856190157.
the seller of the Products, who is the contractual party with the Customer pursuant to these General Terms and Conditions of Sale, is MargheritaB. Srl, headquartered at PIAZZA DELLA VITTORIA 9, 25122 BRESCIA (BS) and having VAT number: 12856190157.
- Orders can only be placed by adults who are not legally incapacitated.
- The language in which the Contract is concluded is Italian. In case of conflict between the versions of the General Conditions prepared in a language other than Italian and accepted by the customer, the meaning and interpretation of the General Conditions in Italian shall prevail.
ARTICLE 1 - Object and conclusion of the contract
With these general terms and conditions of sale, Margherita B. sells to the Customer, who purchases remotely, the Products offered for sale on the site shop.margheritab.com (the “Site”).
The contract is concluded exclusively through the internet, by the Customer accessing the website shop.margheritab.com, by sending a purchase order according to the procedure provided by the site itself and its acceptance by Margherita B.. The purchase order sent by the Customer through the Site has the value of a contractual proposal and is governed by these general terms and conditions of sale which the Customer is required to accept fully and without any reservation. To this end, before proceeding to conclude the order, the Customer undertakes to review these GTC and the pre-contractual information provided on the page.
The sales contract is perfected with the sending by Margherita B. to the Customer of an order confirmation email. The email contains the Customer's data, the order number, the price of the purchased goods, the shipping costs, and the delivery address to which the goods will be sent.
The Customer undertakes to verify the accuracy of the personal data contained therein and to promptly communicate any corrections to Margherita B.
In the order confirmation email, the Customer will also receive the link to download and store a copy of these general terms and conditions of sale, as provided for in art. 51 paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.
ARTICLE 2 - Pre-contractual information for the consumer - art. 49 of Legislative Decree 206/2005
Before concluding the purchase contract, the Customer reviews the characteristics of the goods which are illustrated in the individual product sheets at the time of the Customer's choice. Before concluding the purchase contract and before sending the order, the Customer is informed about:
1. identification of the seller;
2. total price of the goods including taxes, with details of shipping costs and any other charges;
3. payment methods;
4. the deadline within which Margherita B. commits to deliver the goods;
5. the conditions, terms, and procedures to exercise the right of withdrawal (art. 6 of these conditions), as well as the standard withdrawal form attached I, part B of Legislative Decree 21/2014;
6. conditions of after-sales service and commercial guarantees provided.
ARTICLE 3 - Product availability
The availability of products indicated on the site refers to the actual availability at the time the Customer places the order. This availability should still be considered indicative because, due to the simultaneous presence of multiple users on the Site, the Products may be sold to other Customers before the order confirmation.
Where the products subject to the order are not available due to reasons beyond the control of Margherita B., the order will be automatically adjusted by removing the unavailable product.
The Customer accessing the localized Site will have access to the Products available and purchasable in the Country where the Site is localized. The purchased products can only be delivered within the territory of the Country where the Site is localized.
ARTICLE 4 - Prices
All sale prices of the products indicated on the Site are expressed in Euro (€) and include all taxes payable by the consumer.
Shipping costs are not included in the price of the Products but are indicated and calculated at the time of completing the purchase process and before making the payment.
The Customer can use promotional vouchers offered by Margherita B. as part of promotional campaigns for the purchase. These vouchers can only be used according to the methods indicated on the vouchers themselves, cannot be used retroactively and/or transferred to third parties. It is not possible to use multiple promotional vouchers cumulatively for the same order. If for any reason, including withdrawal or return by the Customer, the total value of the order is less than the value of the voucher, Margherita B. reserves the right to invoice the original price of the goods that remain in the possession of the Customer. Promotional vouchers will not be refunded if the buyer decides to return all or part of the goods.
ARTICLE 5 - Payment methods
Margherita B. accepts various payment methods including, for example, credit card, debit card, PayPal, bank transfer, cash on delivery.
Payments can also be made using Promotional Vouchers.
Communications related to payment and the data provided by the Customer at the time of payment take place on dedicated protected lines.
For each order placed on the Site, at the time of payment, Margherita B. will issue a fiscal receipt for the goods shipped.
ARTICLE 6 - Right of withdrawal
In accordance with current provisions, the Customer has the right to withdraw from the purchase within 14 days from the date of receipt of the products.
The Customer who intends to exercise the right of withdrawal must follow the procedure explained on the site at the page How to Make a Return.
The goods must be sent back to Margherita B. using the label and filling out the return form that the Customer will find inside the package in which the goods arrived. By using this label and following the procedures indicated on the site, at the page How to Make a Return, the direct costs of returning the products are borne by Margherita B., exclusively using GLS Courier.
It is the Customer's responsibility to correctly follow the instructions indicated on the Site at the page How to Make a Return.
The goods must be returned intact, in their original packaging, complete in all parts (including price tag, packing material, and any documentation and accessory equipment) and complete with the attached fiscal documentation.
Without prejudice to the right to verify compliance with the above, Margherita B. will refund the amount of the products subject to withdrawal within a maximum period of 20 days.
The Customer is responsible for the decrease in the value of the goods resulting from handling other than what is strictly necessary to establish the nature, characteristics, and functioning of the goods. Therefore, if the returned Products are damaged (for example, showing signs of wear, abrasion, scratches, removal of labels, removal of tags, deformations, etc.), incomplete with all their elements and accessories (including labels and tags intact and attached to the product), not accompanied by the attached instructions/notes/manuals, original packaging and wrapping, and the warranty certificate, if present, the Customer will be liable for the decrease in the asset value of the goods and will be entitled to a refund equal to the residual value of the Product.
As provided by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, Margherita B. may suspend the refund until receipt of the goods or until the Customer has demonstrated that they have returned the goods to the seller.
Margherita B. will process the refund using the same payment method chosen by the Customer at the time of purchase. In the case of payment made in cash, and if the Customer intends to exercise their right of withdrawal, they must provide Margherita B., by accessing the contact us section, with the bank details: IBAN, SWIFT, and BIC necessary for the refund.
ARTICLE 7 - Delivery Methods
Margherita B. will accept only orders to be delivered within Italian territory and the States indicated on the Site. Products will be delivered via GLS Express Courier to the address indicated by the Customer at the time of order within no more than 30 days from the date the Customer receives the order confirmation email.
ARTICLE 8 - Liability
Margherita B. assumes no responsibility for disruptions attributable to force majeure or unforeseen events, including malfunctions and disruptions of the internet network, in cases where it fails to execute the order within the times provided by these GTC.
Whether exercising the right of withdrawal or the right to conformity warranty, if the goods cannot be accepted by the seller because they do not meet the requirements to exercise the rights under articles 6 and 7 above, it is the Customer's duty and responsibility to recover the goods at their own expense once made available. The Customer acknowledges and unconditionally accepts that Margherita B., after 30 days from the notification of the goods being made available to the Customer, may proceed with the lawful disposal of the goods not collected by the Customer.
ARTICLE 9 – Final Clauses
Products are sold with the characteristics described on the Site and according to the GTC published on the Site at the time the order is placed by the Customer, excluding any other conditions or terms.
Margherita B. reserves the right to modify these general terms and conditions of sale at any time, at its sole discretion, without the need to provide any notice to Site users. Any changes made will be effective from the date of publication on the Site and will apply only to sales concluded from that date onward.
Prices, Products for sale on the Site, and their characteristics are subject to change without notice.
These General Terms and Conditions of Sale consist of all the clauses that compose them. If one or more provisions of these General Terms and Conditions of Sale are considered invalid or declared as such under the law, regulation, or following a decision by a competent court, the other provisions shall continue to have full force and effect.
